Terms of Service

This is a legally binding contract between you and MyVIP Fantasy. Please read it carefully. If you have suggestions or questions, contact info@myvipfantasy.com.

1. Your MyVIP Fantasy Account

You must be at least 18 years old to register for a MyVIP Fantasy account and you are responsible for your account.

When you create an account, you must provide accurate information in good faith and keep it updated. To subscribe, publish as a creator, use AI companion calls, or access any adult-oriented area, you must be legally permitted to do so where you live. You are responsible for all activity under your account and for keeping your credentials secure. Contact info@myvipfantasy.com immediately if you believe your account is compromised.

2. Definitions

MyVIP Fantasy provides an adult marketplace for creator profiles, paid posts and media, tips, subscriptions, live streams, human-to-human calls, AI companion calls, AI-generated persona experiences, and related services. When we say "site", we mean myvipfantasy.com and all services offered through our site. When we say "we", "us" or "our" we mean MyVIP Fantasy LLC ("MyVIP Fantasy"). When we say "creator", we mean a person or business using MyVIP Fantasy to publish content, offer paid interactions, receive tips, or operate an approved profile or AI persona. When we say "fan", "member", "subscriber" or "user", we mean a person who browses, buys, subscribes, tips, chats, calls, or otherwise uses the site. When we say "content", we mean text, images, video, audio, live streams, profile data, AI persona materials, messages, prompts, files, and other material posted, uploaded, streamed, generated, protected, sold, or made available through the site. When we say "terms", we mean these terms of service.

3. Accepting these terms

If you do not agree to these terms, you may not register for or use the site. If we make material changes, we may notify you through the site or by email. If you do not agree to changes, you may request account cancellation at info@myvipfantasy.com. Our Data Processing Addendum forms part of these terms where applicable.

4. Payment

MyVIP Fantasy currently uses a Bitcoin-first account balance and checkout model. Fans may add funds by paying BTCPay invoices or by using other funding methods we enable. Bitcoin invoices can expire, be underpaid, be overpaid, or settle at a rate different from an estimate shown before payment. Network fees, miner fees, exchange-rate movement, wallet mistakes, and payment delays are your responsibility unless the law requires otherwise.

Purchases, tips, paid calls, subscriptions, paid posts, media unlocks, and other paid features debit the user's MyVIP Fantasy balance according to the price and channel rules shown at the time of use. We may show approximate fiat values for convenience, but the account ledger and final settlement may be calculated in BTC or another enabled currency depending on the feature and account configuration.

For creators, we calculate creator earnings at transaction time based on the channel, the active platform-fee configuration, the creator or persona type, and any applicable payment, infrastructure, fraud, refund, compliance, tax, or network costs. AI calls and AI persona products may have different fee treatment than human creator products because real-time AI, voice, video, GPU, storage, and moderation costs are materially different. Where an AI persona is operated by MyVIP Fantasy rather than by an independent creator, no creator payout is owed for that transaction.

We will try to make earned balances available on a commercially reasonable schedule through the payout methods enabled for your account. Payout timing, minimums, wallet requirements, verification requirements, and supported currencies may be shown in your dashboard or communicated by admin. We may hold, delay, reverse, offset, or block payments for fraud prevention, compliance review, policy violations, technical errors, refunds, disputes, suspicious activity, sanctions screening, age or identity verification issues, tax reporting, or other risk reasons. If your balance becomes negative, we may recover that amount from future earnings or require repayment.

5. Fees

MyVIP Fantasy does not use a single sitewide 20% fee. Platform fees are configured by product channel and may differ for tips, subscriptions, media unlocks, posts, live streams, human calls, AI calls, creator-owned AI personas, and MyVIP Fantasy-operated AI personas. The fee for a channel may also change over time as we update pricing, costs, risk controls, or promotional programs.

Creators set public prices where the product supports creator pricing, subject to minimums, maximums, floor pricing, anti-abuse controls, and profitability rules we apply. We may reject, adjust, or require changes to prices that are erroneous, impossible to fulfill, undercut required platform costs, violate policy, or create a material risk to MyVIP Fantasy, creators, or users.

Bitcoin funding and payouts may involve network fees, wallet fees, exchange-rate spreads, invoice handling costs, conversion costs, and other third-party or infrastructure charges. We may deduct or pass through those costs where applicable and may display estimated fees before a transaction when the system can reasonably calculate them.

Tax

As legally required, we may collect tax identification information, collect or remit marketplace taxes, and report payments or activity to tax authorities. You are responsible for reporting and paying any income, withholding, sales, VAT, GST, crypto, or other taxes that apply to your use of the site or payments you receive. Creators must provide accurate tax, identity, and payout information when requested.

6. Permitted users

MyVIP Fantasy is designed for adult use only. You must be at least 18 years old to use it. If we learn that we have collected personal information from a minor, we will delete that information as quickly as possible. If you believe that we might have any information from a minor, please contact us at info@myvipfantasy.com. When you use the site, you represent and warrant that you have the legal capacity to form a binding contract with us and are doing so by your agreement to these terms.

7. Copyright and intellectual property

We own our stuff; you own yours.

You retain ownership of content you upload to or otherwise share on the site. By posting, uploading, streaming, generating, or sharing content, you grant us a non-exclusive, sublicensable, royalty-free, worldwide license to host, process, display, transmit, promote, moderate, store, back up, and otherwise use that content in connection with operating and improving the site. This license does not transfer copyright to us.

You may not copy, record, scrape, redistribute, resell, impersonate, deepfake, or commercially exploit another user's content or interaction unless the creator has expressly authorized that use in writing and the use complies with law and our policies. You agree not to reproduce, publish, or distribute content that infringes any third party's trademark, copyright, patent, trade secret, publicity, privacy, or other personal or proprietary right.

All MyVIP Fantasy content, the selection, compilation, arrangement and presentation of materials, and the overall design of the site are owned by us or our licensors and are protected by US and international laws. Use of our content without express prior written permission is prohibited.

myvipfantasy.com, MyVIP Fantasy, and the MyVIP Fantasy logo are trademarks or registered trademarks of MyVIP Fantasy LLC. Our trademarks may not be used without our express written permission.

8. MyVIP Fantasy rules

We have ground rules you must follow when using the site. You agree not to do any of the following:

• Threaten others with violence.
• Use hateful, abusive, harassing, libelous, or obscene language toward others.
• Upload, publish, stream, generate, or distribute material that infringes or violates a third party's rights.
• Upload, publish, stream, generate, or distribute material that promotes illegal activity, could constitute a criminal offense, or otherwise violates law or regulation.
• Upload, publish, stream, generate, or distribute material that promotes racism, bigotry, hatred, exploitation, non-consensual content, or physical harm.
• Upload, publish, stream, generate, or distribute material involving minors, including sexualized, exploitative, or age-ambiguous content.
• Upload or distribute video, audio, photographs, or images of another person without required permission.
• Use the site to send spam, chain letters, junk mail, or unsolicited mass messages.
• Use the site to distribute malware or harmful files.
• Use or attempt to use another person's account.
• Disrupt, attack, overload, scrape, or interfere with the site, servers, networks, payments, or safety systems.
• Attempt to obtain unauthorized access to the site or another account.
• Impersonate another person, creator, business, or platform representative.
• Copy, reverse engineer, decompile, or disassemble site code or functionality except as expressly permitted by law.
• Share adult content with minors or allow minors to access adult content.
• Systematically harvest data from the site or programmatically register accounts.

If it appears you violated these rules, we may remove content, restrict features, hold funds, suspend access, terminate your account, preserve evidence, or report activity to appropriate authorities.

9. Canceling your account

You may request account cancellation through your account settings or by contacting support. Some information may be retained as required for payment records, legal compliance, fraud prevention, safety investigations, dispute handling, tax reporting, backups, or other legitimate business needs.

10. Disclaimer of warranties

The site and our services are provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, perfect memory, perfect AI responses, or error-free operation. You use the site and obtain content or services through the site at your own discretion and risk.

11. Limitations of liability

Under no circumstances, including negligence, shall we be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages resulting from use of or inability to use the site, unauthorized access to or alteration of transmissions or data, loss of profits, loss of use, loss of data, wallet mistakes, payment delays, crypto volatility, or other intangibles, even if we have been advised of the possibility of such damages. The foregoing shall not apply to the extent prohibited by applicable law.

You will not hold MyVIP Fantasy responsible for content or interactions made available through the site by creators, users, or AI systems except to the extent the law requires. We do not guarantee the quality, safety, availability, legality, accuracy, suitability, identity, pricing, timing, memory, personality, response, media quality, stream quality, call quality, or outcome of any creator content, AI interaction, human interaction, paid post, media unlock, subscription, tip, or live stream.

Our total cumulative liability to you for any claims arising from or connected with these terms or the site will not exceed the amounts actually paid to us by you in the twelve-month period immediately preceding your formal written notice of the claim. Multiple claims will not enlarge this limit.

12. Indemnification

You agree to indemnify, defend, and hold harmless us, our officers, directors, employees, members, partners, agents, suppliers, affiliates, and their respective personnel from any claims and expenses, including attorneys' fees, arising out of your use of the site, your content, your paid interactions, your violation of these terms, your violation of law, or your violation of another person's rights. We may assume the exclusive defense and control of any matter subject to indemnification by you, but doing so does not excuse your indemnity obligations.

13. Right to terminate

We may alter, amend, modify, suspend, or terminate the site, any account, any feature, any content, any payment method, any payout method, or any portion of the service at any time in our sole discretion, subject to applicable law.

14. General

These terms shall be governed by and construed in accordance with the laws of the state of Idaho, without giving effect to conflict-of-law provisions. You agree that you will bring any claim or cause of action arising out of your use of the site in the courts located within Los Angeles, California, and you agree to submit to the personal and exclusive jurisdiction of those courts. Any claim or cause of action arising out of your use of the site or these terms must be filed within one year after the claim or cause of action arose or it shall be forever barred, unless prohibited by law. If any provision is determined unenforceable, it will be severed and replaced with a provision that most closely reflects the original intent, and the remaining provisions will remain in effect. No waiver is effective except in a written instrument signed by us. No joint venture, partnership, employment, or agency relationship exists between you and us as a result of these terms or your use of the site. You may not assign any right, interest, or benefit under these terms without our prior written consent. These terms set forth the entire agreement between you and us with respect to the site and supersede prior communications, agreements, and proposals.
